Additionally, it provides information about purchasing procedures, services, and general promotions offered to the public.

Any person, by accessing and using The Site, accepts and fully approves to be bound by the terms and conditions provided herein, as well as the other policies and regulatory content of The Site. Therefore, any person wishing to access and use The Site may only do so under strict compliance with the Terms and Conditions, as well as the other policies, rules, and principles applicable to The Site, whose content and consultation are available on The Site.

In any case, all access and/or use of The Site constitutes acceptance of and submission to these Terms and Conditions, as well as the other policies, rules, and principles of The Site. Any person who does not accept to comply with and submit to what is set forth herein must refrain from accessing and/or using The Site and any of its contents or services.

Therefore, any person who accesses and uses The Site acknowledges having read and understood these Terms and Conditions, as well as the other policies, rules, and principles contained on The Site, and that, as a sign of acceptance of the content and scope of all the foregoing, effectively accesses and uses The Site.

4. USER'S LEGAL CAPACITY

The Services offered through The Site are available solely and exclusively to persons who are legally capable of contracting in accordance with current Panamanian legislation.

Therefore, in no case may persons lacking the aforementioned capacity, especially those who are not of legal age or those who have been disabled from The Site by MIC, MOVIES, AND LITTLE MIC, access and use it.

In any case, if the User who accesses or uses The Site is a legal entity, the natural person acting on its behalf must have the capacity and authority to contract on behalf of the company and, furthermore, to subject it to the terms and conditions of The Site.

5. PURPOSE

The Site, administered and controlled by MIC, MOVIES, AND LITTLE MIC, primarily aims to provide information about its products and promote online purchases by its users. Additionally, it aims to provide information about purchasing procedures, services, and general promotions offered to the public.

6. PROHIBITED USES OF THE SITE

The following activities are not permitted on The Site:

  • Adding pages from The Site within "frames" of external sites.

  • Using any device, program, algorithm, or method to access, acquire, copy, or monitor any part or Content of The Site.

  • Attempting to gain privileged access to any part of The Site, servers, or networks by any method.

7. OFFER

MIC, MOVIES, and LITTLEMIC, through their website micpanama.pa, display the offer of various products listed and/or described on The Site. For a valid purchase offer to exist from MIC, MOVIES, and LITTLEMIC, the User must complete the forms available on The Site electronically, stating the User's personal data, the selection of desired products, the payment method, as well as any other data that MIC, MOVIES, and LITTLEMIC deems necessary for the purchase to be made.

For a purchase made from MIC, MOVIES, AND LITTLE MIC through The Site by selecting one of its offers to be considered perfect, the following conditions must be met:

  • Completion by the User of the aforementioned forms found on The Site. This information will be received and approved by MIC, MOVIES, AND LITTLE MIC.

  • Payment by the User of 100% of the value of the selected merchandise has been made.

  • The User has accepted the Terms and Conditions, Privacy Policies of this site, and other contractual stipulations of The Site.

Once these conditions are met, MIC, MOVIES, AND LITTLE MIC will proceed accordingly, generating a purchase order in the system and informing the User, via a notice on The Site and via email to the indicated address, that their purchase order has been registered in the system with a specific number, which the User can use to track its status. MIC, MOVIES, AND LITTLE MIC reserves the right to modify product prices at any time prior to the acceptance of the offer by the customer, without the need to notify such change in any way, without prejudice to consumer law. For offers that involve a promotional code, only one code per order is allowed.

8. PRODUCTS AND/OR SERVICES

MIC, MOVIES, AND LITTLE MIC is responsible for updating and constantly reviewing the products displayed on The Site. MIC, MOVIES, AND LITTLE MIC may modify and discontinue products at any time and undertakes to dispatch products of the same quality characteristics as those displayed in its points of sale; however, the colors of the products that the customer sees on their monitor depend on the technological characteristics of those devices, therefore, MIC, MOVIES, AND LITTLE MIC does not guarantee that the color displayed on the User's monitor will be exactly the same as the actual color of the product.

Given the above, it is specified that the Site displays product images with the greatest possible clarity, sharpness, and precision. However, the visualization of product color will depend on the electronic instruments used by the Purchasing User when accessing The Site.

9. HOW TO PURCHASE THROUGH THE SITE?

To purchase products displayed on The Site, the interested User must:

2.      Select the product and the appropriate size.

3.      Choose the quantity.

4.      Click on "ADD TO CART".

5.      If your order is complete, select "VIEW CART".

6.      If you wish to continue shopping, select "CONTINUE SHOPPING".

7.      If you have a discount code, enter it in "PROMOTIONAL CODE".

8.      Click on "COMPLETE PURCHASE".

9.      Complete your shipping details and choose your payment method. You can pay with a debit or credit card.

10.   Make payment and complete the purchase.

10. SHIPPING CHARGES AND TAXES

MIC, MOVIES, AND LITTLE MIC will be responsible for handling and insurance costs of products purchased on moviesshop during transportation. The User will bear the cost of shipping the product to its destination. Likewise, the User will be responsible for all sales taxes, value-added taxes, and any other taxes and duties arising from each accepted purchase offer, provided they apply under current legislation. All taxes incurred by the purchase will be settled from the moment the User accepts the purchase offer on The Site, and therefore, they will know the exact amount to pay before doing so.

11. PRODUCT DELIVERY

MIC, MOVIES, AND LITTLE MIC undertakes to make deliveries exclusively within Panamanian territory, in the areas and locations accessible according to the available distribution network. Consequently, the perfection of the sales contract is conditional on the address registered by the User for delivery being within the enabled geographical areas, which are indicated on The Site. If a district of Panamanian territory is not found in the list displayed on The Site for this purpose, it should be understood that this geographical area is not enabled and therefore the contract will not be deemed concluded as the aforementioned condition for its perfection is not met, and consequently, the merchandise will not be shipped.

The products subject to sale will be delivered to the address provided by the User in the electronic form presented on The Site, within a period of seven (7) business days for main cities and ten (10) business days for the rest of the country, counted from the date MIC, MOVIES, AND LITTLE MIC sends the confirmation of the purchase order generated by the system, and provided that the payment terms and conditions have been determined in advance and there are no causes beyond the control of MIC, MOVIES, AND LITTLE MIC that could delay delivery, such as any event of force majeure or fortuitous event. In the event that shipments are destined for a location other than a main city, the delivery time will be informed in each case.

It is understood that any adult person found at the delivery address is authorized by the User to receive their order, and therefore, MIC, MOVIES, AND LITTLE MIC is exempt from any responsibility for the delivery made, provided it is made to the address registered on The Site. The foregoing also applies to delivery at guardhouses of residential units (P.H.) or guardhouses of other types of properties.

If no one receives the order at the designated address, the carrier will make several attempts to redeliver the order; however, if the carrier cannot find someone to deliver the order to, it will proceed to return the products to the respective Store, and MIC, MOVIES, and LITTLE MIC will be responsible for contacting the User to inform them about the situation. At this point, two situations may arise:

1.      MIC, MOVIES, and LITTLE MIC successfully establishes effective contact with the User: in this case, MIC, MOVIES, and LITTLE MIC will contact the carrier again, assume the shipping costs, and dispatch the order again according to the User's instructions.

2.      MIC, MOVIES, and LITTLE MIC fails to contact the user: in this case, MIC, MOVIES, and LITTLE MIC will send a message to the email address provided by the User when placing the order, informing them that contact could not be established, and therefore, a refund will be processed according to the terms established for returns.

Delivery times during advertising campaigns, special campaigns, weather changes, issues with the transport company, among others:

The delivery promise may vary and be longer than seven (7) or ten (10) business days when the website has special and extraordinary events that may lead to an increase in the number of purchases and higher demand. The foregoing will also apply to cases where climatic conditions, the situation of the transport company, or any other extraordinary situation prevent delivery of the product within the initially stipulated period. When these situations are caused by an event attributable to MIC, MOVIES, and LITTLE MIC, the User will be duly informed through the website. **Delivery times due to the COVID-19 pandemic:**

We would like to inform you that delivery periods are references provided by the carriers we currently use; therefore, delivery dates may vary from 2 to 4 business days in major cities and from 2 to 10 business days for the rest of the country; these dates may also be affected due to transport issues occurring nationwide. Conditions beyond our control, such as MOBILITY RESTRICTIONS due to the national quarantine affecting the delivery of your orders, will not give rise to any compensation.

Should any of the events described above occur, MIC, MOVIES, AND LITTLE MIC will contact you to provide an optimal solution; it is necessary to correctly and accurately provide all contact details: phone, email, and shipping address. If there are errors in any of the contact details provided, delivery will not be possible within the aforementioned timeframe.


5. Purchase process:

  • Select your products and add them to the shopping cart.

  • At checkout, enter your personal data and then select "Express Shipping" as the shipping method. * That's it! Receive your order within 24 hours after your purchase is approved.

12. PRODUCT AVAILABILITY

MIC, MOVIES, AND LITTLE MIC is responsible for updating The Site and constantly reviewing the products displayed on it during each periodic closing. Given the above, during purchase executions carried out by Users during the day, product availability may be affected, in which case, MIC, MOVIES, AND LITTLE MIC will immediately undertake any necessary replacements, product exchanges, or returns.

13. PAYMENT

The price to be paid for each item purchased by a User will be as stated on the Site at the time of the purchase offer.

Before processing any purchase request, the User must choose the terms and conditions of payment according to the payment methods available on the Site and of which they are informed through it. MIC, MOVIES, AND LITTLE MIC, through the Site, provides Users with a secure connection system for making transactions on the Site, a system that is managed by entities external to MIC, MOVIES, AND LITTLE MIC.

Once MIC, MOVIES, AND LITTLE MIC verifies the payment and purchase request, the corresponding acceptance of said request will proceed.

Likewise, the User agrees not to use any device, software, or other means to obstruct the proper functioning of the Site.

  • Debit card (CLAVE) backed by a savings or checking account

14. PAYMENT INFORMATION

To proceed with the payment for the products selected by the User, the Site provides a link to the authorized payment methods where the handling of personal information will be the sole responsibility of the payment method provider chosen by the User. Users must accept the Terms and Conditions of Use of the payment method before making their transactions.

Therefore, the User understands and accepts that MIC, MOVIES, AND LITTLE MIC are not responsible for the administration and control of these payment platforms, and thus, exempts them from all types of liability derived from the payment and use of their financial instruments, without prejudice to the right of withdrawal and the right of payment reversal available to consumers.

15. RETURNS AND EXCHANGES

MIC, MOVIES, AND LITTLE MIC will proceed to make exchanges and accept returns of products that have not been used for up to 2 months (60 calendar days) from the date of product delivery.

The exchange and warranty policy applies SOLELY and EXCLUSIVELY for reasons of: legal warranty, size or color, customer preference, incomplete order, or failure to arrive within the established period. As a result of this return, the company will refund the money or generate a virtual voucher in favor of the buyer for the value of the acquired product. In this sense, the customer may choose one of the following options when requesting a product exchange:

1.      Exchange at a physical store: the customer may request an exchange at one of our physical stores and may request the same product in a different size, or request an exchange for a different item. If the exchange is requested for a different item and it has a higher value than the product being exchanged, this surplus must be assumed by the customer. The product for which the exchange is made must have a value equal to or greater than what the customer initially paid for the product being exchanged. If the value of the new product exceeds the value initially paid, the customer must cover the excess.

2.      Exchange at the online store: in the event that the customer does not wish to go to a physical store, they may also request an exchange by contacting customer service or sending an email to the customer service email address (which will be provided later). In this case, the company will proceed to collect the garment at the address indicated by the customer. Once it is received, a voucher will be generated in favor of the customer for the same value as the garment being exchanged.

This voucher can only be used for purchases through the website. In the event that the customer wishes to make a purchase and the final amount to pay is less than the voucher value, the customer can use the voucher and have a remaining balance to use in future purchases. However, if the customer decides to make a purchase for a value greater than the voucher, they will be responsible for covering the excess.

3.      Likewise, the customer may also request a refund of the money paid from the customer service area. However, if the buyer chooses to obtain the virtual voucher, no money refunds will be issued.
In both cases, the customer may exchange the product for one of the same item but in a different size or color, as well as opt to exchange the garment for another of a different item. However, the availability of garments is subject to inventory, so if a garment is out of stock due to inventory reasons, the customer must exchange it for another product that is available.

Returns of intimate apparel and swimwear for both men and women will not be accepted unless they are due to quality, suitability, or safety defects.

16. LEGAL WARRANTY

In compliance with the terms of Article 42 of Law 45 of 2007 and Article 21 of Executive Decree 46 of 2009, MIC, MOVIES, AND LITTLE MIC will provide a warranty on its products under the following terms for those products susceptible to it, solely and exclusively for defects in their quality, suitability, or safety. If accepted as compliant with current regulations, the warranty will proceed under the following terms:

1.      Completely free exchange of the good, as well as its transport, if necessary. In the event that the new product shows faults again, at the User's discretion, a new exchange, total or partial refund of the price paid, or partial or total exchange of the good for another of the same kind, similar characteristics or technical specifications, which in no case may be inferior to those of the product that gave rise to the warranty, will proceed.

2.      The warranty period will be suspended while the consumer is deprived of the use of the product due to the effectiveness of the warranty.

3.      If the product is fully replaced with another, the warranty period for the new product will begin again from the moment the product is replaced.

4.      Once MIC, MOVIES, and LITTLE MIC receive the product to enforce its warranty, they must issue a receipt.

5.      In any case, the legal warranty period is sixty (60) calendar days from the date of product delivery, and in any case, for its applicability, the User must have complied with all care and use standards for the products. To determine the above, the product, once delivered for warranty study, will be subjected to internal studies and the consumer will be notified in writing whether the warranty is recognized or not, explaining the respective reasons and attaching the evidence that justifies the decision.

6.      Once the consumer is notified of the decision to enforce the warranty, they will have a period of fifteen (15) business days to make the good subject to the warranty request available to MIC, MOVIES, AND LITTLE MIC.

7.      When the consumer chooses product replacement, MIC, MOVIES, AND LITTLE MIC will have a period of ten (10) business days to replace it, following the moment the consumer makes the product subject to the warranty available.

8.      When the consumer has opted for a refund of the money for the warranty to be effective, MIC AND LITTLE MIC will have a period of thirty (30) calendar days to make said refund, counted from the date on which the consumer makes the product subject to the warranty request available.

9.      The warranty request can be made through the customer service channels provided by MIC, MOVIES, and LITTLEMIC, i.e., via cell phone [*] or email micservicioalcliente@mic.com.pa. In any case, MIC, MOVIES, AND LITTLE MIC will study each request and resolve it according to the terms of applicable law.

17. REVERSALS

Insofar as sales made through our website are considered sales made through electronic commerce mechanisms, the participants in the payment process may request the reversal of payments requested by the consumer when they are subject to fraud, or correspond to an unsolicited operation, or the purchased product is not received, or the delivered product does not correspond to what was requested or is defective.

Procedure for requesting payment reversal:

1. The consumer must file a complaint with MIC TRADING PANAMA S.A. within five (5) business days from the day they became aware of the fraudulent or unsolicited operation, or when they should have received the product or received it defective or not corresponding to what was requested. Said complaint must be submitted via email to servicioalclientemovies@moviesshop.pa.

2. The complaint must contain the following:

* The reasons supporting the reversal request

* The invoked cause. Only the following causes may be invoked:

  • It was subject to fraud.

  • It was an unsolicited operation.

  • The purchased product was not received.

  • The delivered product does not correspond to what was requested, does not meet the inherent characteristics or those attributed by the information provided about it.

  • The product is defective.

* The amount for which the reversal is requested.

* Indicate the payment instrument to which the operation was charged.

3. If applicable, the consumer must return the goods. For said return, MIC TRADING PANAMA S.A. will proceed to collect the goods under the same conditions and at the same place where they were received.

4. MIC TRADING PANAMA S.A. will provide the consumer with proof of filing the complaint.

5. Likewise, within the same five (5) business days in which the consumer must file the complaint, they must notify the issuer of the electronic payment instrument used to make the product purchase of the payment reversal request. Said notification must contain the following:

* Express statement of the reasons supporting the reversal request.

* Indicate the invoked cause.

* Amount for which the reversal is requested.

* Identification of the transaction.

* Identification of the payment instrument to which the operation was charged.

* Statement of having made the goods available to MIC TRADING PANAMA S.A. for their return.

* Support or proof of filing the complaint with MIC TRADING PANAMA S.A. (or, where appropriate, the sworn declaration when applicable).
NOTE: when the consumer of the goods is not the holder of the payment instrument, the holder must make the notification to the issuer, while the consumer will handle the complaint process with MIC TRADING PANAMA S.A.

6. For reversals, MIC TRADING PANAMA S.A. will have thirty (30) calendar days from the moment the purchase reversal request is received to carry out said reversal.

18. PERSONAL DATA PROTECTION OR "HABEAS DATA"

In the event that MIC, MOVIES, and LITTLE MIC request personal data from the User, they will also request the User's authorization for the processing of personal data, according to the Personal Data Protection Policy available on the Site. By authorizing the processing of personal data, the User accepts that MIC, MOVIES, and LITTLE MIC may use their data for the informed purposes, a processing that will be carried out according to the provisions of Law 81 of 2019 and its Regulatory Decrees.

In any case, it is expressly stated that MIC, MOVIES, AND LITTLE MIC are responsible for the processing of personal information collected through e-commerce, for which acts the current regulations in Panama will apply, with their main obligations being: guaranteeing the effective exercise of the right to personal data protection of users and/or clients; preserving the information under the necessary security conditions to prevent its alteration, loss, consultation, unauthorized or fraudulent use or access; promptly updating, rectifying, or deleting data; processing inquiries and claims filed by the Data Subjects under the terms indicated in Law 81 of 2019 and its regulations, among others.

19. EXEMPTION FROM LIABILITY

MIC, MOVIES, AND LITTLE MIC will not assume any type of responsibility when the User has not timely communicated the existence of a violation of their personal information, or when the User has not proceeded to communicate to the corresponding entities about the improper use, subtraction, or theft of the instruments granted by them to carry out transactions, or when their registration data is improperly used.

In any case, every User of the Site will hold MIC, MOVIES, AND LITTLE MIC, its subsidiaries, controlling companies, and all its personnel harmless from any type of claim or legal action initiated by any person, in accordance with the situations previously mentioned, due to the activities and content of the Site.

20. ADVERTISING AND LINKS

MIC, MOVIES, AND LITTLE MIC may also communicate commercial and advertising information, identifying it as such, to portal users who have authorized it at the time of registration and/or updating their data. The commercial and advertising information sent will be fair and will indicate the conditions under which an offer, discount, contest, or prize proceeds.

Commercial and advertising information communicated to the users of our portal will be framed within the law, morality, and good customs.

21. INTELLECTUAL PROPERTY

Because the content of the Site is protected by intellectual property regulations, unauthorized use of the materials found therein may constitute an infringement of these regulations and even other types of laws such as criminal laws.

Likewise, the use on the Site of some third-party proprietary content is expressly authorized by law. All content on the Site is protected by copyright and trademark laws and by all applicable national and international regulations.

Except as expressly stipulated in these terms and conditions, any act of copying, reproduction, modification, creation of derivative works, sale or distribution, display of the contents, in any manner or by any means, including, but not limited to, electronic, mechanical, photocopying, recording or any other nature, is prohibited without the prior written permission of MIC, MOVIES and LITTLEMIC or the copyright holder.

In no case do these terms and conditions confer rights, licenses, and/or authorizations to perform the acts described above. Any unauthorized use of the content will constitute a violation of these terms and conditions and the current regulations on trademarks, copyrights, and/or other applicable national and international intellectual property regulations.

22. USE OF PHOTOS IN THE GALLERY

By responding to the automatic message with #YesMIC and #YesLITTLE, you authorize us to use your image on our website, giving due credit, to be used as a tool for viewing and purchasing products on our website micservicioalcliente@mic.com.pa. After this authorization, your photo will appear in our gallery and will be associated with our products.

The use of your photo(s) is not linked to any monetary compensation from MIC Y LITTLE MIC (MIC TRADING PANAMA S.A. RUC: 155723282-2-2022), and it is exempt from any type of payment for the use of your image. Your image may be removed from our website in the future if you express it through an official brand channel (social networks, customer service line, online chat, or email). Given that the collection of images must be considered as the collection of personal data, the present collection and the use given are subject to our Privacy Policy, which is available through the Site.

23. COMPUTER SECURITY

23.1. COOKIES

Cookies are small data files that websites like The Site or emails store in the browser and optionally on the hard drive in order to have information about the preferences of Users who use The Site.

MIC, MOVIES Y LITTLE MIC uses a third party to install the respective cookies on the respective User's system and thus obtain non-personal and identifiable information. The foregoing is known through this document by the Users of The Site, and they also accept the use of cookies.

MIC, MOVIES Y LITTLE MIC will diligently execute the technical, administrative, and operational aspects related to the website, using trained personnel for this purpose; however, MIC, MOVIES Y LITTLE MIC are exempt from all responsibility derived from situations of fortuitous events or force majeure, which includes, among other hypotheses, acts of terrorism, sabotage, including cyberattacks, riots, strikes, decisions of sovereign authority, acts or facts of third parties, foreign or internal wars, earthquakes, tsunamis, floods, gales, tornadoes, hurricanes, and, in general, all unforeseen, unforeseeable, or irresistible situations analogous to the foregoing that may directly or indirectly affect the normal functioning of the website.

PARAGRAPH: The suspension of the availability of the Website originating from normal situations of the operation of MIC, MOVIES Y LITTLE MIC, such as, but not limited to, those derived from maintenance, programming, scheduled tests, provisioning or readjustment of equipment or inconveniences of any type in the relevant equipment, are considered justified. When the events described above are foreseeable, MIC, MOVIES Y LITTLE MIC must notify the suspension of the service through its Website, with such anticipation as it deems necessary.

Given the above, MIC, MOVIES Y LITTLE MIC are not responsible under any circumstances for damages, harms, or loss of User information and others, caused by failures in its system or servers.

23.2. SITE PROTECTION

MIC, MOVIES Y LITTLE MIC expressly prohibits the use of any distinctive sign of its property, unless its use is approved by MIC, MOVIES Y LITTLE MIC through a document duly signed by the legally authorized person, in which case, such use may be carried out under the parameters granted in the authorization.

The deployment, utilization, exhibition, copying, or any other form of reproduction of The Site, on sites not controlled by MIC, MOVIES Y LITTLE MIC, are expressly prohibited.

24. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions will be governed and interpreted in accordance with Panamanian legislation and, in any case, any controversy arising from these Terms and Conditions will be subject to the same.

25. INDEPENDENCE OF PROVISIONS

 In the event that one or some of the provisions contained in this document are considered null, illegal, or ineffective in any aspect, the validity, legality, and enforceability or effectiveness of the rest of the provisions of this document will not be affected or annulled by such circumstance.
